This website is operated by Berry Unique (“we/us”). As a user of this website you acknowledge that any use of this website including any transactions you make is subject to the terms and conditions as set out below.
1.1 “Consumer” means an individual who purchase and use goods and services offered on Website.
1.2 Registered in Northern Ireland as a Sole Trader.
1.3 “berryunique.co.uk” means on-line store owed by Sole Trader also referred to as “we”, “us” or “Berry Unique” in these terms and conditions.
1.4 “Working days” means Monday to Friday, excluding Bank or other Public Holidays.
1.5 “Goods” means products and services available to purchase on-line.
1.6 “Website” means www.berryunique.co.uk.
1.7 “Proof” means digital reflection of Goods before they are printed. Proof is an image file created in X-1a:2001 compliant format, in Europe ISO Coated FOGRA27 colour profile and gives great impression of how printed Goods will look like when order is completed.
1.8 “Turnaround” means number of Working days required for production (print, finishing and packing). Turnaround counts from the following day we receive Proof approval to print.
2.Description of Goods/Warranty and Liability
2.1 We guarantee that the Goods will correspond approximately to the description given to customer via the Website and/or via email correspondence.
The majorty of products we print/produce/sell are custom made and it is not practical to publish detailed specifications of all the products.
All images, descriptive matter and advertising are for the sole purpose of giving an approximate description of the goods. Because of the way colours are displayed differently on different screens, actual print and product colours may differ slightly from how they appear on screen.
2.2 We reserve the right to alter any details of products advertised without notice and while every effort is made to describe goods accurately in the advertisement no warranty is given as to accuracy and no responsibility will be accepted for error or spelling mistake and any resulting loss.
3.Prices & Payment
3.1 All prices quoted on this website are correct at the time of publication. Any applicable carriage is payable by the customer in addition to the displayed price.
3.2 We reserve rights to modify the prices without notice but with no affect to existing or past orders.
3.3 Goods are subject to availability. In the event that we are unable to supply the goods, we will inform you as soon as possible. A full refund will be given where you have already paid for the goods.
3.4 Payments are made via Nochex or Paypal. We are pleased to accept major Credit and Debit Cards through our Third Party Payment Processors. The Payment method can be chosen at the time of the order.
Nochex is a UK based 3D secure card processor and does not require you to have an account - just enter your card details and your order is placed.
To pay with Paypal, you do not need a Paypal account in order to pay by credit/debit card - just follow the 'pay with Paypal' instructions and you can enter your card details.
3.5 We undertake not to take or retain any details of your credit or debit cards at any time during your use of this website.
3.6 Every order needs to be paid at the time it’s placed. Payment will be taken from your card at the time we receive your order.
3.7 We only accept GBP (Sterling) payments. Person who makes an order has to be over 18 years old.
3.8 We will take all reasonable precautions to keep the details of your order and payment secure. We cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.
3.9 By placing an order at berryunique.co.uk you are accepting our terms and conditions.
4. Privacy and Cookies
To purchase from us we need to collect your name, address, email address and phone number. We will never share these details with a third party (other than providing details to the courier company to enable delivery). We do not store or have access to your credit/debit card details which are handled by secure third party payment providers e.g. Nochex and Paypal.
We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online.
A cookie is a small file which asks permission to be placed on your computer's hard drive. Once you agree, the file is added and the cookie helps analyse web traffic or lets you know when you visit a particular site. Cookies allow web applications to respond to you as an individual. The web application can tailor its operations to your needs, likes and dislikes by gathering and remembering information about your preferences.
This website uses 'performance cookies'. Our website may contain links to other websites of interest. However, once you have used these links to leave our site, you should note that we do not have any control over that other website. Therefore, we cannot be responsible for the protection and privacy of any information which you provide whilst visiting such sites and such sites are not governed by this privacy statement. You should exercise caution and look at the privacy statement applicable to the website in question.
5.1 Should you wish to return your item please notify us in writing within 14 days of receiving the item by emailing firstname.lastname@example.org with the subject of the email entitled "Returns". We are not obliged to accept returns that are not notified in advance to us or that are notified to us later than 14 days from receipt of item.
5.2 The item should then be returned within 14 days and should be sufficiently packaged for transit using the original or equivalent packaging. The item must be returned in re-saleable condition in order for a refund to be issued. It is recommended that you use a tracked method of postage so that you have proof of returning the item. We cannot issue refunds for return items that are lost in transit without proof of sending, or are damaged in transit due to inadequate packaging.
5.3 Please note that the refund will not include return postage, the cost of which is incurred by the buyer. Where an item is deemed faulty on receipt, return postage costs will also be refunded (evidence will be required).
5.4 Refunds are usually processed as the return item is received, but in accordance with Consumer Rights regulations will be made no later than 14 days of receiving the returned item.
5.5 Please note that in accordance with the Consumer Regulations personalised items/prints are non-cancellable/non-refundable although refunds/replacement will still apply for damage caused in transit. It may be neccessary for the damaged item to be sent back to us and if this is the case the points 5.1-5.4 will still apply.
6. Limitation of Liability
6.1 In no event shall we or our subsidiaries, affiliates, officers, agents, business partners or employees, be liable for any special, incidental, indirect, or consequential damages of any kind, or for any damages whatsoever resulting from loss of use, data or profits, whether or not we have been advised of possibility of the damage, arising out of or in connection with the use or performance of the site or of failure to provide services that you order from us or our affiliates, including without limitation, damages arising from mistake, omission, virus, delay, or interruption of service.You also acknowledge that in no event shall we be liable or responsible for any damages or consequences arising from or related to your inappropriate or unauthorized use of the site or its content.
"Berry Unique", "we" and "us" used on this website refers to Lorna Markey who operates Berry Unique as a sole trader.
7. Promotion Codes7.1 Promotion codes are only valid for orders placed online.
7.2 Promotion codes entitle you, at the time of ordering, to a saving on an order placed as stated in the advertisement shown via Instagram or Facebook.
7.3 Berry Unique reserves the right to decline to accept orders where, in its opinion, a promotion code is invalid for the order being placed.
7.4 Promotion codes are only valid on specific products while stocks last and may be withdrawn at any time.
7.5 Only one promotion code can be used per order.
